Terms and Conditions of Use

1. SERVICES OFFERED

1.1 These Terms and Conditions are intended to establish regulations for the use of the services offered by Grupo RjpServer to users, allowing them to learn about and contract, through the internet, the IT services provided, as well as, when applicable, make the respective online payment.

1.2 The services of Grupo RjpServer consist of providing, through its website(s), a platform that allows users to learn about, select, and contract IT services remotely, which may include consulting, technical support, software development, hosting, maintenance, among others.

1.3 The user acknowledges that all services are provided remotely, unless otherwise stated, and some may involve the use of third-party platforms, technological partnerships, or external support tools.

1.4 The prices of the services presented on this site are the sole responsibility of Grupo RjpServer. Prices may differ from those offered in personalized proposals or other direct sales channels, with services contracted online being an autonomous aspect and subject to their own conditions.

2. REGISTRATION

2.1 The user, in order to use the services described above, must have legal capacity for civil acts and must necessarily provide the information required at registration, assuming full responsibility, including civil and criminal, for the accuracy and truthfulness of the information provided at registration, which may be verified at any time by Grupo RjpServer or another entity contracted by Grupo RjpServer for this purpose.

2.2 In case of incorrect, false, or unverified information, or in the event of refusal to correct it or send documentation proving the correction, Grupo RjpServer reserves the right not to complete the ongoing registration and/or to block the existing registration, preventing the user from using the online services until, at the discretion of Grupo RjpServer, the irregular situation is resolved.
Grupo RjpServer reserves the right to prevent, at its discretion, new registrations, or to cancel an existing one, if an anomaly is detected that, in its analysis, is deemed serious or demonstrates a deliberate attempt to alter the rules described herein, which are mandatory for all users.
Grupo RjpServer will also take legal action if it verifies non-compliance by the user with any obligation provided for in these Terms and Conditions.

2.3 Once registration is successfully completed, the user will have access to the services through a login (username and password), which the user agrees not to disclose to third parties, being solely responsible for any service request made using their login.

2.4 The user hereby unreservedly authorizes and acknowledges that the data provided by them will be stored on servers in Portugal, but may be moved and/or copied inside the European Community.

3. USER OBLIGATIONS

3.1 After successful registration on the Grupo RjpServer platform, the user agrees not to disclose their access credentials (username and password) to third parties, nor allow others to use them.
The user is solely responsible for any misuse resulting from sharing or failing to protect these credentials.

3.2 The user is responsible for providing true, complete, and up-to-date information at the time of registration, assuming full legal and contractual consequences resulting from false, incomplete, or outdated information, particularly for invoicing or technical contact purposes.

3.3 The user agrees to fully pay for the services requested from Grupo RjpServer, according to the conditions presented on the platform or previously agreed in writing.
Payment may be made online or through other means indicated by Grupo RjpServer.

3.4 Only individuals over 18 years old may register and contract services on the Grupo RjpServer platform.
The user declares and guarantees, at the time of registration, that they are of legal age to enter into binding contracts.

3.5 The user authorizes the use of comments, ratings, and feedback submitted about Grupo RjpServer services, which may be used for advertising purposes.

3.6 The user agrees to keep their contact information up to date, namely phone number and email, to allow contact by Grupo RjpServer regarding the provision of services.
If contact is not possible due to incorrect data, Grupo RjpServer reserves the right to cancel the service without refund and, if applicable, charge associated costs.

4. OBLIGATIONS OF GRUPO RJPSERVER

4.1 Grupo RjpServer undertakes to provide on its website a digital platform that allows the user to consult all offered IT services, with the possibility of being redirected to specific platforms or pages where services can be contracted directly and payment can be made.

4.2 Grupo RjpServer undertakes to protect, through secure servers and appropriate technological practices, the confidentiality and integrity of all personal data and financial information provided by users.
However, Grupo RjpServer cannot be held liable for damages resulting from unauthorized access caused by cyberattacks, security breaches beyond its control, or malicious actions by third parties compromising security systems.

4.3 Grupo RjpServer is obligated to perform the contracted services diligently, within the agreed deadlines, and according to the previously described technical conditions.

4.4 Grupo RjpServer undertakes to provide technical support within the announced hours and channels (e.g., email, chat, phone).

4.5 Grupo RjpServer undertakes to issue invoices for all contracted and paid services, in accordance with applicable legislation, and to maintain accounting records as required.

4.6 Grupo RjpServer undertakes not to use the user's data for any purpose other than what is strictly necessary to perform the contracted service.

4.7 Grupo RjpServer may provide certain services or products free of charge.
These are offered "as is", with no warranties of any kind, express or implied.
Grupo RjpServer assumes no responsibility for failures, unavailability, data loss, malfunction, or any other damage resulting from the use of these free services.
Grupo RjpServer reserves the right to modify, limit, or discontinue these free services at any time, without prior notice and without any compensation to the user.

5. LIMITATION OF LIABILITY

5.1 Grupo RjpServer provides its services based on best practices, using appropriate technological tools and resources.
However, it does not guarantee that the operation of its systems will be continuous, uninterrupted, or error-free.

5.2 Grupo RjpServer is not responsible for losses resulting from technical failures, temporary unavailability, human errors, external attacks (such as DDoS, malware, etc.), interruptions of third-party services (e.g., hosting, payments, external APIs) or any other event beyond the control of Grupo RjpServer.

5.3 The liability of Grupo RjpServer, whenever applicable, is limited to the amount paid by the user for the specific service in question, never exceeding that amount, and never covering indirect damages, loss of profits, data loss, or any other collateral damage.

5.4 Regarding services or products provided for free, the user expressly accepts that:
(a) They are provided “as is”;
(b) There is no guarantee of operation, quality or continuity;
(c) Grupo RjpServer may modify, suspend or remove them at any time, without prior notice and without any liability.

6. INTELLECTUAL PROPERTY

6.1 All content on Grupo RjpServer's websites and platforms, including but not limited to source code, design, logos, trademarks, texts, images, videos, trade names, database structures and software, are the exclusive property of Grupo RjpServer or have been licensed for its use, and are protected by copyright and other applicable laws.

6.2 It is strictly prohibited for the user to copy, reproduce, modify, distribute, transmit, display, publish, sell, license or otherwise exploit, in whole or in part, any content from Grupo RjpServer, except with express written authorization.

6.3 Contracting services from Grupo RjpServer does not grant the user any ownership rights over the software, scripts, methodologies or structures used in the provision of the service, except where clearly stipulated in the contract.

6.4 The user guarantees not to use Grupo RjpServer's services or platforms to violate third-party intellectual property rights.
In the event of infringement, the responsibility lies solely with the user, and may result in the immediate suspension of the service.

6.5 If the user submits content to the platform (e.g., comments, technical feedback, suggestions), they automatically grant Grupo RjpServer a free, irrevocable, and worldwide license to use, reproduce, and adapt such content.

7. MODIFICATIONS TO THESE TERMS AND CONDITIONS

7.1 These Terms and Conditions may, at any time, have their content or part of it modified for adjustments and insertions, aiming at improving the services provided.

7.2 The new conditions will take effect as soon as they are included in these Terms and Conditions, and the user may express opposition to any of the modified Terms and Conditions by cancelling their account through the website.

8. COMMUNICATION CHANNEL AND VALIDITY OF COMMUNICATIONS

8.1 To establish contact between Grupo RjpServer and the user, a communication channel will be provided through the Contact form, and it is the user's responsibility to keep their email address up to date.
All communications sent by email will have legal validity and be considered delivered for all legal purposes.

8.2 The user also undertakes to keep their telephone contact details up to date, to allow direct contact by Grupo RjpServer, whenever necessary, in the context of providing the contracted services or for additional verification.

8.3 The user acknowledges that they may be contacted by Grupo RjpServer services in the case of ordering services with a value equal to or greater than €1000.00, as a means of identity validation and request legitimacy verification.
Grupo RjpServer reserves the right to refuse, suspend or cancel any order if contact with the user is not possible, without any right to compensation.

9. BILLING

9.1 By acquiring services or products, the user expressly accepts that the invoice is issued for the total amount of the requested service after successful payment.

9.2 Invoices are sent by email, to the address the user provided during registration or available for download in the specified folder after successful payment.

9.3 When placing their order, if the user wishes to receive an invoice with Tax ID (NIF), they must indicate it during the address registration step.

9.4 The billing process is carried out up to 5 days after the acquisition of the service/product and after successful payment.

10. POINTS (RJPSERVERS)

10.1 Each time you purchase in our online stores, you will accumulate points hereinafter called RJPSERVERS, to spend on your future purchases in our online stores.

10.2 The RJPSERVERS accumulate across stores.

10.3 The RJPSERVERS cannot be transferred between users.

10.4 In case of account deactivation, there is no refund or transfer of RJPSERVERS to another account.

10.5 They are credited to your user account with the following equivalence: 1€ = 2 RJPSERVERS.

10.6 The accumulated RJPSERVERS are lifelong until spent.

10.7 The RJPSERVERS are available after successful payment and can only be spent in our online stores.

10.8 The RJPSERVERS can only be used for offers described on the platforms.

10.9 To check your RJPSERVERS, you must log in as a user.

11. PURCHASE OF (RJPSERVERS)

11.1 For your convenience, you can buy RJPSERVERS to load your account with the following equivalence: 1€ = 100 RJPSERVERS.

11.2 The RJPSERVERS when purchased have a bonus of up to 10%.

11.3 It is not allowed to buy RJPSERVERS using other RJPSERVERS.

11.4 Purchased RJPSERVERS accumulate across stores.

11.5 Purchased RJPSERVERS cannot be transferred between users.

11.6 In case of account deactivation, there is no refund or transfer of purchased RJPSERVERS to another account.

11.7 Purchased RJPSERVERS are lifelong until spent.

11.8 Purchased RJPSERVERS are available after successful payment and can only be spent in our online stores.

11.9 Purchased RJPSERVERS can only be used for offers described on the platforms.

11.10 To check your purchased RJPSERVERS, you must log in as a user.

12. ACCEPTANCE OF TERMS AND CONDITIONS OF USE

12.1 The user declares that they have read, understood, and accept all rules, conditions, and obligations established in these Terms and Conditions.

13. LEGALITY OF TERMS AND CONDITIONS

13.1 These Terms and Conditions are governed by Portuguese law.

13.2 If any provision of these Terms and Conditions is deemed invalid, illegal, or unenforceable by a competent authority, the remaining provisions shall remain in full force and effect.
The invalid part shall be interpreted, whenever possible, to reflect the original intention of the parties, without affecting the validity of the remaining content.

13.3 In case of dispute regarding the interpretation or execution of these Terms and Conditions, the parties agree to submit to the jurisdiction of the Barreiro district court, expressly waiving any other jurisdiction.
